3. First Readings: Town Attorney David Gaskill
a. Ordinance 2025-03 Amending Ch. 8 Business Licenses Article II Licenses (Strategic Plan: DS4)
Mr. Gaskill stated this was the first reading, and the public hearing would be held at the next

meeting on Monday, August 11 . Ordinance 2025-03 allowed the Mayor and Council to
have the ability to sanction business owners if issues arose. Mr. Gaskill found this newly
proposed Ordinance to be sufficient. Vice President Burrell asked for Section C5 to be
amended to state, “Fighting and/or disorderly conduct on the premises or emanating from
the premises.” As he believed, it clarified that responsibility fell upon the place where the
issue first occurred. The Mayor and Council agreed.
On the motion of Vice President Burrell, second by Councilmember Nichols, the decision to
update the language found under 5C was adopted by the following vote and would be
incorporated into the Ordinance for the Public Hearing scheduled for August 11, 2025:

b. Ordinance 2025-04: Amending Ch. 8 Business Licenses Article III Peddling & Soliciting
(Strategic Plan: DS2, DS4)
Mr. Gaskill reminded the public that the public hearing would be held at the next meeting on

Monday, August 11 . He felt as though the Mayor and Council were happy with the
proposed changes for the Peddling & Soliciting licenses, per the discussion held by the
Mayor and Council last meeting. Councilmember Orris expressed concern regarding
confusion around some of the explanations and definitions within the proposed Ordinance.
He inquired about the protocol for “No Trespassing / Soliciting” signs and discussed his
research on outlawing soliciting being unconstitutional.
Ms. Bohlen reminded him that prohibiting solicitation would not stop solicitors from
approaching homes, just as speed limit signs would not stop everyone from speeding. Mr.
Gaskill and Chief Downing both advised to clearly post “No Soliciting” signs on and around
the property to make sure solicitors were aware of said signs. If solicitors refused to leave
the property, they could be charged for trespassing. Chief Downing also informed
Councilmember Orris that the rules were explained and given to solicitors at the time of
obtaining the license.
